These Terms of Use govern the use of the application “Groupfinder” (hereinafter: the Application). KVEST OÜ, registry code 16355231, located at Tulbi 4-1, Tallinn 10612, Estonia (hereinafter: KVEST), is the administrator and owner of the Application. The following Terms regulate the legal relationship between KVEST and users of the Application. All users of the Application are bound by these Terms.

1. General Provisions

1.1. In interpreting legal relationships arising from use of the Application, the parties follow the Law of Obligations Act, other applicable laws and regulations of the Republic of Estonia, and the agreements stated in these Terms. 1.2. KVEST has the right to unilaterally amend the Terms at any time by notifying users on the Application’s website. Continued use of the Application after amendments constitutes acceptance of the updated Terms. 1.3. If any provision of these Terms is found invalid under applicable law, the remaining provisions remain in force.

2. Acceptance of Terms and Eligibility

2.1. By accessing or using the Application, the user agrees to be bound by these Terms. 2.2. Users must meet the minimum legal age requirement in their jurisdiction. 2.3. Users confirm that all information submitted is accurate and not misleading.

3. Accounts and User Responsibility

3.1. Users are responsible for safeguarding login credentials and all activities conducted under their account. 3.2. Accounts may not be shared or transferred. 3.3. KVEST does not actively pre screen, validate, or verify user generated content. Users are solely responsible for their content and interactions. 3.4. KVEST may, without justification, refuse to approve a registration application and create an Account. KVEST may also cancel a User’s Account and delete all related data from the Application environment without justification or prior notice.

4. Cookies and Data Usage

4.1. The Application uses cookies strictly necessary for essential functionality, including authentication, session management, and security. 4.2. Use of the Application requires the placement of these mandatory cookies on the user’s device. Without them, core functionality cannot operate. 4.3. The Application may offer optional analytics cookies, activated only with user consent. 4.4. Analytics data is anonymized, not linked to individual user accounts, and used solely to improve performance and user experience.

5. Data Protection and GDPR Compliance

5.1. KVEST processes personal data in accordance with Regulation EU 2016/679, the General Data Protection Regulation, and applicable Estonian data protection laws. 5.2. KVEST acts as the data controller for personal data processed in connection with the operation of the Application. 5.3. Personal data is processed solely for purposes necessary to:

• provide access to the Application,
• maintain user accounts,
• ensure security and fraud prevention,
• comply with legal obligations.

5.4. Users have the rights provided under GDPR, including the right to access, rectify, erase, restrict processing, object to processing, and request data portability, subject to legal limitations. 5.5. Requests related to personal data must be submitted in writing to KVEST. KVEST will respond within the timeframes required by applicable law. 5.6. Further details regarding data processing, retention periods, and data subject rights are provided in the Privacy Policy, which forms an integral part of these Terms.

6. Right to Submit Complaints

6.1. Users may file a complaint with KVEST regarding a Service within 3 days of the Service being provided. 6.2. Complaints must be submitted via the Application or by email, in English, with a clear description of the issue. Supporting evidence, including photos, may be required. 6.3. KVEST will promptly forward the complaint to the relevant User, request their comments, and review the complaint no later than the next business day. 6.4. KVEST will assess the validity of the complaint subjectively and based solely on the data submitted and collected. 6.5. If KVEST determines the complaint is valid and a User violated these Terms, KVEST may withhold the entire Service usage and apply enforcement measures.

7. Platform Purpose and Acceptable Use

7.1. The Application exists to allow individual users to create profiles and post specific tabletop roleplaying game listings with a fixed number of available seats. 7.2. Profiles must represent individuals. Community profiles or organizational recruitment accounts are not permitted. 7.3. Game listings must describe a specific session or campaign with a defined number of seats. 7.4. Recruiting for external communities, servers, services, or any group requiring ongoing recruitment is prohibited. 7.5. Listings requiring an undefined number of players will be treated as community recruitment and removed. 7.6. Deleting and reposting listings to refresh visibility is prohibited. The Application provides a bump feature for that purpose. 7.7. When offering any paid games or services related to a group, the relevant pricing and payment information must be clearly stated upfront in the post.

8. Messaging and Communication Rules

8.1. Repeated unsolicited messaging, spam, or mass messaging is prohibited. 8.2. If a user states that they are not interested in paid game offers, they must not be contacted regarding such offers. 8.3. Harassment or persistent unwanted contact may result in suspension or permanent ban. 8.4. KVEST may implement technical or legal measures to prevent circumvention of restrictions.

9. Intellectual Property

9.1. Users may only post content they own or have the legal right to publish. 9.2. Posting infringing material is prohibited. 9.3. Users bear full responsibility for intellectual property violations arising from their content.

10. Enforcement and Termination

10.1. KVEST reserves the right to remove content, restrict accounts, suspend users, or permanently terminate access in case of violations. 10.2. Attempts to bypass enforcement measures may result in permanent removal and preventative technical action.

11. Disclaimer and Limitation of Liability

11.1. The Application functions as an intermediary platform. 11.2. KVEST does not verify users, validate listings, or guarantee content accuracy. 11.3. To the fullest extent permitted by Estonian law, KVEST shall not be liable for disputes, damages, or losses arising from user interactions.

12. Governing Law

These Terms are governed by the laws of the Republic of Estonia.

13. Binding Nature of the Terms

13.1. By creating an Account, checking the box “I agree with the terms of Use,” and clicking “Sign up”, the User confirms that they have read, understood, and agree to the Terms and accept their validity. 13.2. These Terms are binding and enforceable in full for the User.
