KVEST OÜ, registry code 16355231, located at Tulbi 4-1, Tallinn 10612, Estonia (hereinafter: KVEST), is the administrator and owner of the application “Groupfinder” (hereinafter: the Application). The following Terms of Use apply to the legal relationship between KVEST and users of the Application (hereinafter: the Terms). All users of the Application are bound by these Terms.
1. General Provisions
1.1. In interpreting the legal relationships arising from the use of the Application, the parties follow the Law of Obligations Act, other laws and regulations of the Republic of Estonia, and the agreements stated in these Terms.
1.2. KVEST has the right to unilaterally amend the Terms at any time by notifying users on the Application’s website.
2. Nature of the Application and Terms of Use
2.1. The Application is an environment created and managed by KVEST that enables registered individuals (hereinafter: Users) to post various listings (Services) and to use Services posted by other registered Users.
2.2. Only Users registered in a separate, specialized parallel application may offer Services.
2.3. Since the Application is merely a means of communication between Users, KVEST cannot influence or be responsible for the quality or deficiencies of the Services. KVEST does not guarantee that Services offered through the Application will always be provided correctly or without faults. KVEST does not itself offer Services and is not responsible for their quality, acting only as an intermediary.
2.4. The User must ensure that any content they upload complies with legal requirements and these Terms, and that they have the necessary rights to upload such content. It is forbidden to upload content that includes malware, viruses, or otherwise damages or interferes with the proper functioning of the Application or is illegal to share.
3. Account Registration
3.1. Upon submission of a registration application, a user account (hereinafter: Account) will be created. KVEST will notify the User of Account creation via email.
3.2. To log in, the User must enter their email address and password.
3.3. To protect their Account, the User agrees to keep their password confidential and ensures that third parties cannot access Services through the Account without their knowledge.
3.4. KVEST may, without justification, refuse to approve a registration application and create an Account. KVEST may also cancel a User’s Account and delete all related data from the Application environment without justification or prior notice.
4. Service Quality
4.1. The User must ensure that the Service complies with the terms of the agreement.
4.2. KVEST is not responsible for any deficiencies in the Service or its compliance. Any claims related to deficiencies must be directed to and resolved with the User providing the Service.
5. Right to Submit Complaints
5.1. Users may file a Complaint with KVEST regarding a Service within 3 days of the Service being provided.
5.2. Complaints must be submitted via the Application or by email, in English, with a clear description of the issue. Photos may be required as evidence.
5.3. KVEST will promptly forward the Complaint to the relevant User, request their comments, and review the Complaint no later than the next business day.
5.4. KVEST will assess the validity of the Complaint subjectively and based solely on the data submitted and collected.
5.5. If KVEST determines the Complaint is valid and the User violated the terms, KVEST may withhold the entire Service usage.
6. Processing of Personal Data
6.1. The User consents to KVEST processing their personal data.
6.2. Personal data provided during Account creation and order submission is stored in an electronic registry and used to communicate with the User.
6.3. The User agrees to the use of their contact information to receive offers from KVEST. They may request to stop receiving offers or to have their contact information deleted at any time.
6.4. The basis for data collection and processing is the creation of a user relationship via Account registration. Processing of personal data is a prerequisite for ordering Services.
6.5. Personal data is processed by KVEST OÜ, registry code 16355231, Tulbi 4-1, Tallinn 10612, Estonia.
6.6. KVEST agrees not to share personal data with third parties except as stated in these Terms.
6.7. KVEST may disclose personal data if required by law.
6.8. The User has the right to review, modify, or request the deletion of their personal data from KVEST's or Users’ databases.
6.9. The User consents to KVEST sending the following to the email address provided during Account creation or order placement:
a. Confirmations and notifications as described in these Terms or necessary for proper use of the Application (e.g. account creation confirmation, order confirmation);
b. Newsletters if the User has opted in by checking the relevant box. The User may later withdraw this consent via the unsubscribe link at the end of the email.
7. User Responsibility and Dispute Resolution
7.1. The User agrees to use the Application in accordance with the law and good practice.
7.2. The User is liable for any damage caused to KVEST, other Users, or third parties due to misuse or violation of these Terms or applicable laws.
7.3. Disputes arising from these Terms will be resolved in accordance with Estonian law. If no agreement can be reached, disputes will be settled in Harju County Court.
8. Binding Nature of the Terms
8.1. By creating an Account, checking the box “I agree with the terms of Use,” and clicking “Sign up”, the User confirms that they have read, understood, and agree to the Terms and accept their validity.
8.2. These Terms are binding and enforceable in full for the User.
